It happened on Thursday, February 11th, 2010.
The location was a small interrogations room inside the Sarasota County Criminal Justice building located in downtown Sarasota, Florida. There was nothing special about the room. It was drably painted, windowless, with a small table and three chairs. Inside two men waited dressed in business suits for the arrival of a county prisoner named Delmer Smith
One, Ned Foy, was a Sheriff’s Detective from Manatee County. The other was Sarasota Sheriff’s Detective Michael Dumer. Prior to entering the room, Detective Foy had given Detective Dumer an envelope with a court document, a warrant, to be read to Delmer Smith.
The warrant had been issued to Ned Foy the day before by a Manatee County judge to arrest Delmer Smith for the murder of Kathleen Briles on August 3, 2009. However, Delmer Smith was, at that point in time, a resident in the Sarasota County Jail and therefore the warrant had to be read by Detective Dumer as Detective Foy had no authority there. The detectives wait was short as two jail deputies arrived with a hand and ankle cuffed Smith.
Detective Dumer wasted little time in reading the document to Delmer Smith who they seated at the table surrounded by law enforcement officers. When he was finished, Dumer nodded to Detective Foy who then attempted to speak to the prisoner.
